Law firm Carter Capner Law is reaching out to Australian households as they launch a Coles Woolworths Class Action Lawsuit against Australia’s two big supermarket giants after the Australian Competition and Consumer Commission (ACCC) accused them of making misleading discount pricing claims on hundreds of widely sold supermarket products with their “Prices Dropped” and “Down Down” sales campaigns.
If you or your family shopped at Woolworths or Coles between September 2021 and May 2023, you may be eligible for compensation, according to Carter Capner Law.
Woolworths and Coles Price Deception Allegations
I’m sure most of us remember both of these campaigns (and their catchy slogans) but, according to the ACCC, these campaigns were deceitful and involved pricing manipulations that impacted shoppers across Australia.
This potential Coles Woolworths class action lawsuit over price deception is of a massive scale as the law firm urges any Woolworths and Coles shoppers to reach out.
“If you regularly shopped at Woolworths or Coles during this period, you may be entitled to compensation,” states the Carter Capner Law site. “Early estimates suggest that households could claim between $2,000 and $5,000, depending on the amount spent and the impact of the deceptive pricing.”
What are Coles and Woolworths accused of?
Woolworths and Coles allegedly increased the prices of certain products by at least 15% for a short period before placing them in deceptive promotional campaigns such as “Prices Dropped” or “Down Down.”
The ACCC claims that these promotions misled consumers by displaying inaccurate “was” prices, making the discounts appear larger than they were.
The class action won’t commence until they get 20,000 registration and can register on their website at cartercapner.com.au.
The Australian Competition and Consumer Commission (ACCC) alleges the conduct involved 266 products for Woolworths at different times across 20 months and 245 products for Coles at different times across 15 months.
“We all notice prices going up, but when they say, “Down, down,” we believed them. That deception is what the class action aims to address,” Peter Carter states in an interview.
Examples of Products Affected by the Coles Woolworths Class Action
Coles implemented the “Down Down” campaign, which purported to offer sustained price reductions. The ACCC alleges that these promotional claims were misleading, as they were based on inflated prices that were only temporarily increased to create the illusion of a discount.
Allegedly, the deceptive pricing affected over 245 items across categories like snacks, personal care, dairy, pet food, and household products.
Period of Misconduct:
The misleading promotional practices are said to have taken place over 15 months, from February 2022 to May 2023.

One example of such behaviour is when Woolworths increased the price of the Oreo Family Pack from $3.50 to $5.00 for just 22 days, then placed it back on a “Prices Dropped” promotion at $4.50—29% higher than the original price. Similarly, Coles increased the price of Strepsils Throat Lozenges from $5.50 to $7.00 for 28 days.

What is the Woolies Coles lawsuit about?
In a nutshell: Price deception. False advertising. False promises and the financial impact on consumers who regularly shopped at these supermarkets.
Where did the claims come from?
The class action lawsuit came after the Australian Competition and Consumer Commission (ACCC) alleged both Coles and Woolworths made misleading discount pricing claims on hundreds of widely sold supermarket products with their “Prices Dropped” and “Down Down” sales campaigns.
The allegations involve 266 products for Woolworths at different times across 20 months, and 245 products for Coles at different times across 15 months.

The claim relies on their breaches of the Australian Consumer Law Sections 18 (misleading/deceptive conduct)20, 21 (unconscionable conduct) and 29 (misleading representation re price of goods).
What sort of claims are expected?
According to Carter, “For example, if a household spends $500 weekly and was deceived by 10%, that’s $50 a week, or $2,000 to $3,000 over time. That’s the scale we’re looking at.”
